Lives of the Prophets - Prophet Dawud* (continued)

Fasting of Dawud*
The Prophet* said, "The most beloved prayer to Allah was the prayer of Prophet Dawud*, and the most beloved fasting to Allah was the fasting of Prophet Dawud*. He used to sleep the (first half) of the night and pray for one third of it and then sleep one-sixth of it, and he used to fast on alternate days and would not flee on facing the enemy."
In addition to his melodious voice, Prophet Dawud*, was fast in reciting his Book, the Zabur (Psalms). Imam Ahmad reports that The Prophet* said: "The reciting (of the Psalms) was made easy for Prophet Dawud*. He used to order that his riding animal be saddled, and would finish reciting the Qur’an before it was saddled. And he would never eat except from the earnings of his manual work. " The word 'Qur'an' in this Hadith refers to the Psalms which Allah revealed to him. Allah the Almighty says: "And We gave to Dawud* (the gift of) the Psalms." (AI Israa': 55)
As for Allah's saying, "We strengthened his kingdom", it means that Allah granted him great power and authority and respected, sound judgement.
Allah says: "O Dawud! We did indeed make thee a vicegerent (Khalifah) on earth: so judge thou between men in truth (and justice): nor follow thou the lust (of thy heart), for it will mislead thee from the Path of Allah: for those who wander astray from the Path of Allah, is a Penalty Grievous, for that they forget the Day of Account." (Saad: 26)
Ibn Kathir maintains: This speech of Allah has been directed to Dawud*, yet it is also directed to all rulers and commanders. They are all commanded to abide by justice and follow the truth revealed by Allah, not their whims and desires. Then Allah warns them that if they deviated from Allah's path, they would suffer a grievous chastisement on the Day of Judgement.
Dawud* set the best example of justice and sincere and intense worship to Allah. He offered several extra devotional acts and made his family follow his example. Thus Allah praises them saying, "Work ye, Sons of Dawud*, in thanks! But few of My servants are grateful." (Saba': 13)

The Age of Dawud*:
There is a Hadith reported about the creation of Adam mentions that when Allah drew from Adam's back his descendants and showed him the Prophets among them, Adam saw amongst them a light shining brightly (man with a shining face), so he asked, 'O my Lord! Who is this man'?' Allah said, 'This is your son, Dawud.' He asked, 'O my Lord! How old will be he?' Allah said, '60 years.' He said, 'O my Lord! Increase his age.' Allah said, 'I will not increase it except out of your own age.' (Adam had known from Allah that his own age would be one thousand years) so he granted Dawud* 40 years of his age. When Adam's life came to an end, the angel of death came to take his soul. Then (Adam) said, 'There still remain 40 years of my age.' He forgot that he had gifted Dawud* with them.

Death of Prophet Dawud*
The Prophet* said: "(Prophet) Dawud* was a very private man. When he left his house, he used to lock it up so that none may enter it until he returned. One day he went out and locked up the house. Then while his wife was walking in the house, she found a man standing in the middle of the house. She asked those who were in the house (i.e. its inhabitants), 'How did this man enter the house though it is locked up? By Allah, Dawud* will reproach us today.' When Dawud* came back, he found the man standing in the middle of the house. He asked him, 'Who are you?' He (the man) replied, 'I am the one who does not fear nor be prevented by gatekeepers. Dawud* said, 'By Allah, you are the angel of death. Welcome to Allah's command. Dawud* remained until the angel took his soul. After he was washed and wrapped in the shroud, the sun rose over him. Solomon said to the birds, 'Give Dawud* shade.' They did so till it became dark. Then Solomon said to the birds, 'Hold one wing in. ' Abu Hurairah said that Prophet Muhammad, peace and blessings be upon him, began to show us how the birds held a wing in and held his arm in and the falcons gave him more shade than other birds that day. "

Sins Make You Become Weak
Bani Israel became weak because of their sins. The Philistines took away from them the ark of the covenant. The Philistines were able to defeat them.
Even Though Bani Israel didn’t like to fight They Admitted That Jihad Was The Solution To Their Problems

They asked a king to be appointed to lead them in jihad. The Prophet* said: “Whenever a people abandon Jihad, Allah envelopes them with His punishment” [Tabarani]
Bani Israel Objected To Talut (Saul) As Their King Because Of His Poverty
When you are poor, people use it to look down on you.
Historically, Bani Israel Have A Problem With Allah's Decisions
They had a problem with Talut being appointed as the king. They rebelled and said they have more wealth than him so he can't be their king.
Humans Cannot Tell Allah Who To Bless
The people of Mecca used to ask why Allah sent the Quran down on Muhammad*. You can't tell Allah who to bless. But Allah chooses for His Mercy whom He wills. And Allah is the Owner of Great Bounty. (Al-Baqarah 2:105)
Hypocrites Sometimes Join The Caravan/Crowd for ulterior motives
Talut realised there were hypocrites in the army. This took place in the time of the Prophet* as well. They want the booty or right hand possess. Only a few passed the test of not drinking water.
Always Have Tawakkul When You Go To The Frontline
But those who knew with certainty that they were to meet their Lord, said: "How often a small group overcame a mighty host by Allah's Leave?" And Allah is with As-Sabirin (the patient ones, etc.). (TMQ 2:249)
Always Make A Dua Before You Fight The Enemy
The Prophet* did it at Badr. King Talut did it before he fought the Philistines. And when they advanced to meet Jalut (Goliath) and his forces, they invoked: "Our Lord! Pour forth on us patience, set our feet firm and make us victorious over the disbelieving people." (TMQ 2:250) Always make a dua before you take on the enemy.
Youth Are Effective On The Battlefield
A lot of the sahabas were teenagers when they went to the battlefield. Dawud* killed Goliath when he was a teenager. When Tariq bin Ziyad conquered Spain, he was only 18. When Muhammad al Fateh conquered Turkey in 1453, he was only 19.
Dawud* Didn't Allow Fame To Get To His Head
He didn't allow the fame to get to his head because of his taqwa. When fame gets to your head, you are no longer sincere.
Allah Elevated Dawud* Because He Remained Humble
Dawud* didn't let the fame get to him.
Always Listen To Both Sides Of The Story
Dawud* had to make tawba because he only listened to one side of the story when he was tested by two angels.
It Is Possible For People To Promise You Something And Then Change Their Mind
Adam* did it to Dawud*. Adam* promised to give Dawud* 40 of his years. Narrated Abu Hurairah: that the Prophet* said: He (Adam) said: 'O Lord! Add forty years from my life to his.' So at the end of Adam's life, the Angel of death of came to him, and he said: 'Do I not have forty years remaining?' He said: 'Did you not give them to your son Dawud?'" He said: "Adam denied, so his offspring denied, and Adam forgot and his offspring forgot, and Adam sinned, so his offspring sinned." [at-Tirmidhi] When the angel of death came to him, Adam* changed his mind.
Prophet Dawud* Was Skilful With Time Management.
As a believer, you need to respect time He divided his day into four parts:
·         1/4 to earn a living
·         1/4 to take rest and ibada
·         1/4 to listen to the problems of the people and to adjudicate in matters
·         1/4 to give classes to the people.
You learn from Prophet Dawud* that he did not waste his time. He used to have a night routine too:
·         sleep the (first half) of the night and

·         then sleep one-sixth of it,
Also, he used to fast on alternate days and would not flee on facing the enemy.
Prophet Dawud* Was Very Patient With His Flock
The litigants jumped over the wall. A litigant is a person who takes his case to the courthouse and demand; his rights because he assumed his oppressed. The litigants jumped over the wall to see Prophet Dawud*. Prophet Dawud* quickly passed the verdict before hearing the complete story and realized they were angels. He begged Allah to forgive him.
Judging Between People Is A Spiritual Status
For someone to pass judgement, you have to be pious. Disputes are a never-ending thing until the day of judgement. “O you who believe! Stand out firmly for justice, as witnesses to Allah, even though it be against yourselves, or your parents, or your kin, be he rich or poor, Allah is a Better Protector to both (than you). So follow not the lusts (of your hearts), lest you may avoid justice, and if you distort your witness or refuse to give it, verily, Allah is Ever Well­ Acquainted with what you do.” (An-Nisa 4:135)
This verse is hung up at Harvard University. Harvard University is impressed by this verse No other verse can surpass this verse in regards to justice. 
Even Though The Litigants Had Bad Manners, He Still Had To Give Them The Correct Verdict
Prophet Dawud* was still obligated to give the right verdict even though they had bad manners.
Even Prophets Are Tested
The two men who jumped over wall to complain to Prophet Dawud*, was a test because he listened to only one side of the story. They came in the form of men but they were angels and itt was halal for them to jump over the wall because they were angels': angels have no human desires. They came to test Prophet Dawud*
To Have A Sweet Voice Is A Great Blessing From Allah
When Prophet Dawud* use to recite the psalms all the animals would gather around Allah does not like the harsh voice; harsh voice is referred to as the voice of the donkey. Abu Huraira is reported to have heard The Prophet* as saying: Allah does not listen to anything, (more approvingly) as He listens to a Prophet reciting loudly the Qur'an in a sweet voice. [Bukhari]
"And be moderate (or show no insolence) in your walking, and lower your voice. Verily, the harshest of all voices is the voice (braying) of the ass." (Luqman 31:19)

The Smoke
There is an entire surah in the Qur’an – Surah ad-Dukhaan. Allah says: “Wait until smoke comes down from the heavens.” This smoke is punishment for the non believers. We don’t know more about the smoke. It will come down on the earth as a punishment for the non-believers.
Rise of the Sun from the West
Allah says, “When some of the signs of Allah approach, then a soul that did not believe, their belief will not do them any good.” The tafsir of this ayah is the rise of the sun from the west.
“Do they then wait for anything other than that the angels should come to them, or that your Lord should come, or that some of the Signs of your Lord should come (i.e. portents of the Hour e.g., arising of the sun from the west)! The day that some of the Signs of your Lord do come, no good will it do to a person to believe then, if he believed not before, nor earned good (by performing deeds of righteousness) through his Faith. Say: “Wait you! we (too) are waiting.”

The Prophet* says, the day of judgment will not occur until the sun rises up from the west. When that happens, everyone would believe. That is when belief would not give them any good. [Bukhari] There is a finality about this sign – such that people see this extra-ordinary sign there is no other explanation for it and it marks the ‘End of the World’ or the ‘End of Time’ as any deeds done after that will not count as the ‘book of deeds’ is already closed. People will know that death is imminent and final and there is no time for repentance. Al-Qurtubi explains this and says that when the sun rises from the west, people would know it is the end. Therefore, it is just like death. When people are dying and they see the angel of death and they cannot make tawbah (repentance)  because it is too late.
If someone becomes a Muslim in that moment, their iman will not do any good. That means, if someone who claims to be a believer but was not doing good, their good will not do them any good after the sun rises from the west. Therefore, after the sun rises from the west, your record of deeds will remain the same. If you were doing righteous deeds, the reward of those deeds would continue even if the sun rises from the west.

The Beast
Allah says: “And when the decree of Allah (or the Word of Allah) befalls them, we would send out to them a beast from the earth. It would talk to them. The people do not believe in Our signs.” The scholars say that the Beast will either talk to them or mark them. This beast would come out and talk to people: “You are a believer” “You are a non-believer” and it would stamp them on the faces.
Abu Hurayrah says that The Prophet* says, “Three things, when they occur, no soul would benefit from imaan/belief after that. 1) Rise of the sun from the west. 2) ad-dajjaal. 3) the beast.” During the time of ad-dajjaal, because there will be so much fitna. In the time of the beast, you will be stamped as a believer or a non-believer.
The Prophet* said, “The beast would come out carrying the seal of Suleiman [Solomon] and the stick of Musa [Moses]. It would mark the face of the believer with Musa and would stamp the face of the nonbeliever with the seal of Suleiman. People would be eating together and they would say, ‘Give me this, believer’ or ‘Hand me this non-believer.’” [at-Tarmidhi]
Everybody has it written on their face. People would call each other, “ya kaafir” or ”ya mu’min.”

The Fire
The final sign of the Day of Judgment is the fire. The Prophet* says, “And in the end, a fire would come out from Yemen, sending the people towards al-mahshar.” This is a fire that will push all of the people towards the holy land. This fire will continuously follow them until they go to Palestine/Syria. People will be running from it. Whoever is left behind, it will burn them. It follows them day and night.
The Prophet* pinpointed the area and said it will come from the basin of Adan.
The Prophet* pointed towards ash-Shaam and said, “This is where you would be assembled.” In another hadith in Abu Dawud, The Prophet* said, “There will be hijra after hijra. The best of people of the world will be in the place of the hijra of Ibrahim.”
Ash-Shaam is the area of Jerusalem, Syria, Palestine, Jordan and Lebanon. The most holy of it is Jerusalem. There are many ahadith where The Prophet* praised that place. In one hadith in Musnad Imam Ahmad, Abu Dardaa reports that The Prophet* says, “I was sleeping and I saw a dream where the pillar of the Book [Qur’an] was taken away from me. And I thought it would be taken away from me. So I followed it and saw it placed in Ash-Shaam. In the time of trials and tribulations (fitan), that is where Imaan will be.”
In another hadith in Tabarani, The Prophet* says, “When I was in the trip of al Isra`, I saw a white pillar like a banner of war taken away from me and I asked the angels, ‘Where are you taking it?’ They said, ‘We are going to take it and place it in Ash-Shaam.’”
This is the end of the signs of the Day of Judgment. It is important to reiterate that altough these are going to happen in the future, probably not in our lifetime, we still have an obligation to know and to prepare for our End because our Day of Judgment begins when we die.
We talked about the hadith of the Prophet* where the man asked him about the Hour: a Bedouin came into the masjid and asked the Prophet*, “When is the Hour?” He came in and interrupted the Prophet* when he was giving a speech. RasulAllah* kept on going and didn’t give him any attention. The man insisted and asked a second and a third time. By now, the sahabah are upset and want him to calm down. They thought that RasulAllah* is not responding because he doesn’t like the question. When RasulAllah* was done with his speech, he said, “Where is the one who was asking about the Hour?” He then asked the Bedouin, “What have you prepared for it?” The man then said, “I did not prepare for it a lot of fasting and prayer, but I have prepared for it with love for Allah and His Messenger.” The Prophet* said, “You will be with the ones that you love.”
InshaAllah, we make du’a that we also have love for Allah and the Prophet* and are also with the ones we love on the Day of Judgment. Ameen

Lives of the Prophets: Musa* starts his Mission.

Allah reminds Musa* about the favours He has done for Musa just prior to sending Musa* on his mission. Allah mentions in Surah Ta-Ha: We were gracious to you another time when We revealed to your mother: "Place him into the chest and throw it into the sea and the sea will wash it up on the shore, where an enemy of Mine and his will pick it up." I showered you with love from Me so that you would be brought up under My supervision. When your sister went and said, "Shall I direct you to someone who will take care of him?" that was how We returned you to your mother so that she might delight her eyes and not be grieved. You killed a man and We rescued you from trouble and tested you with many trials. You stayed some years among the people of Midian. Then you arrived at the pre-ordained time, Moses! I have chosen you for Myself. (TMQ 20:37-41)

Musa* has 2 objectives from Allah:
- Talk to Pharaoh and convince him about Islam
- Ask Pharaoh to free Bani Israel as he has been oppressive

How to do Dawah: Advice from Allah
Musa* then travels home to Egypt and meets his family / tribe. No doubt he explains his mission and gives hope to his people and congratulates his brother Harun on becoming a Prophet! It is likely that the people start to talk about Musa and hope returns to Bani Israel – and Pharaohs’ spies will probably hear of the rumour too!
Prior to their visit to Pharaoh, Allah warned Musa* and the Prophet Harun (Aaron) and reminded them to always remember Him, and to never slacken in remembering Him: "Go, you and your brother, with My Signs and do not slacken in remembering Me." (TMQ 20: 42)
Allah commanded Musa* and Harun* to go to Pharaoh, the ruler of Egypt. Allah explained to them that Pharaoh was arrogant and contentious, but nevertheless, He commanded them to adopt a gentle manner in communicating His message to him: "Go to Pharaoh; he has overstepped the bounds. But speak to him with gentle words so that hopefully he will pay heed or show some fear." (TMQ 20: 43-44 )
Hence it is important to talk gently and softly when communicating the religion, even when the one he is conversing with is arrogant. However, this style of talking gently does not mean avoiding difficult issues like punishment, hellfire (or modern issues like dress, mortgages). This was part of the test for Musa* and his brother – although Allah knows the outcome of the Dawah!
Musa* is worried that Pharaoh will persecute him – especially as he is a wanted man in Egypt and had to flee in a hurry: They said, "Our Lord, we are afraid that he might persecute us or overstep the bounds." (TMQ 20: 45)
He (Moses) said, "My Lord, I killed one of them and I am afraid they will kill me." (TMQ 28: 33)
Go to him and say, "We are your Lord's Messengers so send the tribe of Israel away with us and do not punish them. We have brought you a Sign from your Lord. Peace be upon those who follow the guidance." (TMQ 20: 47)
He (Allah) said, "Have no fear. I will be with you, All-Hearing and All-Seeing." (TMQ 20: 46)
Going before the indisputable ruler of the land, to whom the whole nation submitted like a deity (Allah is beyond that), was certainly seemingly a very hazardous task according to the conditions of the time. Even more dangerous was telling Pharaoh explicitly that he was on the wrong path, and then to ask him to give freedom to an enslaved nation, that is, to the Children of Israel. Nevertheless, aware that they were under the total protection of Allah, Musa* and Harun went to Pharaoh.

Meeting with Pharaoh
It’s not easy for anybody to go see the Pharaoh because of all the security – but Musa is familiar with the ways of the Palace and probably knows people. Also, it is possible that Pharaoh was expecting him as rumours will be circulating in his Kingdom…
Then after them We sent Moses and Harun with Our Signs to Pharaoh and his ruling circle, but they were arrogant and were a people of evildoers. (TMQ 10: 75)
There was dialogue between Pharaoh and Musa*  (see below) but Musa* was accused of being mad, a magician and a liar; in addition he was mocked by the Pharaoh – all responses that our Prophet* also faced.
Pharaoh said, "Who then is your Lord, Moses?"
He said, "Our Lord is He Who gives each thing its created form and then guides it."
He (Pharaoh) said, "What about the previous generations?"
He said, "Knowledge of them is with my Lord in a Book. My Lord does not misplace nor does He forget."
It is He Who made the earth a cradle for you and threaded pathways for you through it and sent down water from the sky by which We have brought forth various different types of plants. Eat and pasture your cattle. Certainly there are Signs in that for men of understanding. From it We created you, to it We will return you, and from it We will bring you forth a second time. (TMQ 20: 49-55)
Rather than evaluating this message with a sound mind and clear conscience, Pharaoh and his inner circle assessed it based on their accustomed way of thinking, founded on the deviant religion of their ancestors. According to their superstitious beliefs, Pharaoh was a deity (Allah is beyond that), far from admitting the idea of the existence of Allah:But when Moses brought them Our Clear Signs they said, "This is nothing but trumped-up magic. We never heard anything like this among our earlier forefathers." (TMQ 28: 36)

Main Topic: Islamic Opinion on Moonsighting

Although moon-sighting is a controversial topic, it is one we need to periodically revisit.
This is not having a go at anybody or group but to clarify the position as many people will be sinning if missing out on a day of fasting or fasting during Eid. There is individual responsibility and just blaming the local imam or mosque is not a sufficient excuse as everyone bears their own responsibility for doing the right thing.
Many of the excuses try to look for loopholes in Islam when justifying what they WANT to do rather than following the strongest legal opinion. Most other excuses no do even classify as legal opinions (ijtehad) and so are not allowed to be followed. We talked about this when we studied Usul al-Fiqh!
Some people will not like what is written but we need to discuss these Fiqh topics on the basis of Qur'an and Sunnah (evidence - 'daleel') and not emotion.

All Muslims are obliged to start Ramadhan or celebrate Eid on the same day…No matter where the moon is sighted

If a Muslim country announces that the sighting of a new moon has been confirmed according to the lawful way - for the beginning of Ramadhan or for the day of Eid – then you have to fast or celebrate It is forbidden to wait for a ruler or scholar in your part of the world to give you permission to fast or celebrate.

WHY?
Because this is what Allah* and the Prophet* ordered. To prove this is the case we have to look at…
* The Quran
* The Sunnah

What we can’t look at to prove things are Islamic are …
* Our emotions
* What people think
* What most people are doing
* What is normal is our community
* What the tradition is.
Remember what Ibn Masud said: "The jama'a is truth [haq] even if it is one person".

The Qur’an says…"Whoever witnesses the crescent of the month, he must fast the month." [2:185], and "They ask you about the crescents. Say: They are but signs to mark fixed periods of time in the affairs of men and for pilgrimage." [2:189]

The Prophet* said:
The Prophet* mentioned Ramadhan and with a gesture of his hands said: "The month is thus and thus. (He then withdrew His thumb at the third time indicating 29)." He then said: "Fast when you see it, and break your fast when you see it. And if the weather is cloudy do calculate it (the months of Shaban and Shawwal) as thirty days." [Muslim]
He also said; "Do not fast till you see the new moon, and do not break fast till you see it; but if the weather is cloudy complete it (thirty days)." [Bukhari]
"The month consists of 29 nights, so do not fast till you have sighted it (the new moon), and if the weather were cloudy, then complete it as thirty days." [Bukhari]
"The month of Ramadhan may consist of twenty-nine days. So do not fast until you have sighted it (the new moon) and do not break fast, until you have sighted it (the new moon of Shawwal), and if the sky is cloudy for you, then complete it (thirty days)." [Muslim]
"The month of Ramadhan may consist of twenty-nine days; so when you see the new moon observe fast and when you see (the new moon again of Shawwal) then break it. And if the sky is cloudy for you, then calculate it (and complete thirty days)." [Muslim]

These narrations are very clear. The Qur’an and the Prophet* order us to fast when the sighting of the new moon of Ramadhan is confirmed, and order us to break the fast and celebrate Eid when the sighting of the new moon of Shawwal is confirmed.
We have to follow these orders of the Quran and the Prophet*. We would be sinful if we didn’t. Just like we would be sinful if we didn’t listen to the Quran and Prophet* for another order like praying salah.
The command to fast is general so it applies to everyone – no matter where they live

When the Qur’an and Prophet* order us to fast or celebrate Eid – they are ordering every Muslim – everywhere in the world. In the hadith, the Prophet* commands us to fast using the word ‘sumu’- ‘do fast’. This word is in the plural form which means the command is general and comprehensive. This means that it applies to all Muslims, no matter where they live.
"Do fast [sumuw] when it is sighted and break fast when it is sighted." In the hadith, the Prophet* commands us to fast using the word ‘ruyateh’ – ‘sighting’. This word is general. This means that Muslims have to fast after any legitimate sighting of the moon regardless of where the moon was sighted. "Do fast when it is sighted [ru’yateh] and break fast when it is sighted."
Even the Prophet* used to begin fasting when he had not personally seen the moon, but a Muslim had told him that he had seen it. Ibn Umar (r) reported, "During the time of the Prophet*, the companions went looking for the new crescent. So I told the Prophet* that I saw it. So he fasted and told the companions to fast." [Abu Dawud and Hakim]
So if the moon was sighted in Morocco do Muslims in Indonesia fast? YES
During the life of the Prophet* the Muslims used to start the fast on the same day and break it on the same day, despite the fact that they lived in different areas. This is another Islamic evidence that the sighting of the new moon in one area obliges all the Muslims to fast together on the same day and celebrate Eid on the same day.

Here’s what some scholars said about every Muslim fasting

Ibn Taymiyyah: “…a person who learns about the sighting of the moon in good time to be able to utilise it for fasting, for ending his fast, or for sacrifice, he must definitely do so. The texts [of Islam] and the reports about the Salaf point to this. To limit this to a certain distance or country would contradict both the reason and the Islamic law.”
The famous Hanafi scholar Imam Sarkhasi (died 483 A.H.) quotes the narration from Abu Dawud (2333, 2334) that; The Muslims did not begin fasting since they did not see the moon. Then a man, from out of Madinah, came and told the Prophet* that he had seen it (the moon). The Prophet* asked him if he was a Muslim to which the man answered ‘yes’. The Prophet* then said: "Allahu-Akbar! one is enough for all Muslims" The Prophet* fasted and asked the people to stop eating and start fasting

What If The News Reaches Us Too Late To Fast On The Same Morning?

This has also been answered in the ahadith. It is also reported in an authentic hadith: Abu ‘Umayr ibn Anas reported from his paternal uncles among the Ansaar who said: "It was cloudy and we could not see the new moon of Shawwaal, so we started the day fasting, then a caravan came at the end of the day and told the Messenger* that they had seen the new moon of Shawwaal the day before, so he told the people to stop fasting, and they went out to pray the Eid prayer the next day."

Deobandi Scholars
The co-founder of Dar al-Uloom Deoband, Maulana Rasheed Ahmad Gangohi said: "If the people of Calcutta sighted the moon in Friday, whereas it was sighted in Makkah on Thursday, but the people of Calcutta did not know of it (the sighting on Thursday); then whenever they come to know of this, it will be obligatory for them to celebrate eid with the people of Makkah and make up (Qada') for the first fasting

Bareylvi Opinion
The founder of the Barylevi movement, Maulana Ahmad Raza Khan, said: "In the correct and authentic mazhab of our Imams, with regard to the sighting of moon for Ramdhan and Eid, distance of the place of sighting is of no consideration. The sighting of the east is binding upon west and vice versa i.e. the sighting of west is similarly binding on east."

Is the idea for all Muslims to fast on one day something new?

No. Imam Kasanee said in his book Bada as-Sana'i said that following other than one sighting for the whole Ummah is an innovation [bid’a]. This indicates how weak he felt that the other Ijtihad is.
Imam Juzairi in his book The Fiqh of the Four Schools of Thought [Vol 1] gives two views of the Hanafis about this:
1) The sighting of the moon by any Muslim should be accepted whether slave, free, man or woman without inquiring whether they are just or not,
2) The justness [of the witness] should be verified by a judge [Qadi].

This all sounds simple – so what reasons do people use for not fasting on one day?
  • Reason 1 – times of fasting are like times of prayer – they’re different in each area
Every country should start Ramadhan and celebrate Eid based on their own sighting of the moon, in the same way each region begins its prayer time according to the sun in that area.
The answer: It’s right to say that prayer times differ in each area, because they are based on the times the sun sets and rises – this happens at different times in each region.
So the times we Start fasting and Break fasting is different for each region. Because Allah* says: "And eat and drink until the white thread of dawn appears to you distinct from its black thread; then complete your fast until the night appears" [2:187] But the day we Start Ramadhan and Celebrate Eid must be the same all over the world. Because this is what the narrations have clearly indicated; and this is what is confirmed by the understanding deduced from the Shari'ah rule.

  • Reason 2 – The companions of the Prophet* did not fast at the same time
Another reason given by some is that the companions of one region would not fast at the same time as the companions of a different region. The evidence for this is taken from a report by Imam Muslim about Kurayb who reported that a lady sent him to Mu'awiya  in Al-Sham for some business.
Kurayb said: "I arrived in Al-Sham and did business for her. It was there in Al-Sham that the month of Ramadhan began. I saw the new moon of Ramadhan on Friday. “I then came back to Madina at the end of the month. Abdullah Ibnu Abbas  asked me about the new moon of Ramadhan and said: "When did you see it?" I said: "We saw it on the night of Friday," He said: "Did you see it yourself?" I said: "Yes, and the people also saw it and observed the fast and Mu'awiya  also observed the fast; He said: "But we saw it on Saturday night. Some would continue to observe fast till we complete thirty (fasts) or we see it (the new moon of Shawwal)." I said: "Is the sighting of the moon by Mu'awiya  not valid for you?" He said: "No, this is how the Messenger of Allah* has commanded us."
THIS IS THE CLAIM…That Ibnu Abbas ignored the sighting of the people of Al-Sham and so at the end of the narration said: ‘…this is how the Messenger* has commanded us.’ Some people say that Ibnu Abbas learnt from the Messenger* that the people of one region are not obliged to fast on the sighting of another region. It’s also said that this hadith explains and specifies the hadith : “ Fast when you see it and break fast when you see it.”
Some therefore claim that the people of each region are commanded to act on the sighting of the new moon in their region only and not in other regions. Therefore the beginning of fast and the beginning of Eid vary from one region to another, according to the times of rising of the moon.
THE ANSWER —
1. This report is not a hadith of the Messenger* but the legal opinion [ijtihad] of a companion.
2. The fact that Ibnu Abbas  did not act upon the sighting of the people of Al-Sham reflects his legal opinion [ijtihad] and it cannot be used as a Shari'ah evidence.
3. The reason for this is that when we have a hadith saying one thing and a legal opinin [ijtihad] saying something else – the hadith must be acted on and the legal opinion [ijtihad] has to be left.
4. The ijtihad of the sahabi cannot specify the general term of the hadith.
5. So when Ibnu Abbas said: "This is how the Messenger of Allah* commanded us", this is not a hadith. It is just the way Ibnu Abbas understood the hadith of the Prophet* in which the Messenger* said: "Fast when you see it and break fast when you see it."
This indicates that Ibnu Abbas understood the hadith as such; though he did not say the words: “This is how the Messenger* reported it,” nor did he say: “This is how we learnt it from the Messenger*.” But he said: “This is how the Messenger* commanded us.”
What did Imam Al-Shawkani say about this hadith? He said:…And what is referred in his saying: ‘This is how the Messenger* commanded us’, is his saying (i.e. Ibnu Abbas). “…And the command of the Messenger* lies in the hadith extracted by Bukhari and Muslim, among others, with the following wording: "Do not fast till you see the new moon and do not break fast till you see the new moon, and if the sky were cloudy, then complete it as thirty days." And this does not specifically apply for the people of one region to the exclusion of others, but to all the Muslims.”

Why can’t we use calculations?

Calculating the times when the new moon for Ramadhan and Eid - can’t replace an actual sighting of the new moon with the human eye. The reason for this is that the narrations which mention when to start fasting and end fasting mention seeing the moon with the eyes themselves.
What role can calculation play? Calculations can help us know around what time the new moon will be born and therefore the right time to start looking out for the new moon.
What role can’t calculation play? Governments who use these calculations instead of the sighting, their actions contradict the Qur’an and hadith. Therefore their actions are haram/unlawful and the Muslims are forbidden from relying on their announcements.
Why? All the narrations about the sighting of the moon use the word "ru'yatehe" which comes from the word "ra'a" to refer to the sighting.
The moon is a single, physical, object. This is why the narrations which use the word ‘ru’yatehe’ refer to the moon, mean to see the moon with the eyes.
There’s no analogy in ritual worships
1. There can be no analogy [qiyas] in ritual worships (Ibadaat).
2. This analogy contradicts the definite meaning in narrations which clearly show that the cause [sabab] for fasting is the sighting of the moon.
* Therefore, it is quite clear that the arguments presented to "justify" the beginning of Ramadan / Eid through the use of calculations are invalid and haram.
* The only way to determine the arrival of Ramadan / Eidis through sighting the moon.
What did some of the classical scholars say about calculating the sighting of the moon?
Imam Malik bin Anas (ra) said: "If you see an Imam who does not begin and end fasting by way of sighting, but begins fasting by calculation, he should not be followed in prayer or emulated."

What about sticking with the majority?

Some people claim that Muslims must follow what the majority are practicing. They attempt to misquote Islamic texts about "holding on to the Jama'a (group)". They misinterpret these to mean the ‘Jumhoor' (majority).
Islam has obliged sticking to the jama'ah [group] of Muslims under an Imam (Khalifah). Islam did not oblige sticking to the majority.
Al-Bukhari narrated: "The people used to ask the Prophet* about the good and I used to ask him about the bad in fear that it might catch me. So I said: O Prophet of Allah! We were in times of ignorance and mischief then Allah brought us this good, so is there any mischief after this good? He* said: Yes. I said: Will there be any good after that mischief? He said: Yes, and it has smoke. I said: What is its smoke? He said: (Some) people guide without any guidance, you recognise some (from them) and deny some. I said: Will there be a mischief after that good? He said: Yes, (some) people who invite at the doors of hell, whoever accepted their invitation they throw him in it (hell). I said: O Prophet of Allah, describe them to us. He said: They are of our own skin (of our people) and talk our language. I said: What do you order me to do if that (matter) caught me? He said: Adhere to the jama'ah of Muslims and their Imam. I said: What if the Muslims have no jama'ah nor an Imam? He said: Then you abandon all those groups, even if you have to grab with your teeth the trunk of a tree till death comes to you as such."
What is this hadith asking us to do?
The concept of following the majority rather than following Islam is not based on evidence from the Qur'an and Sunnah and contradicts many evidences about enjoining the good and forbidding the evil even in the face of hardship. The Prophet* said: "The master of martyrs is Hamza, and a man who stands up to a tyrant ruler and gives him advice [nasiha]- and so the ruler kills him."

The disease of nationalism
The disease of nationalism has affected us. Why is it people follow only the sighting in their nation? Who has created the borders between these nations? Why is it that in Delhi, people will follow the sighting in any other part of India but not of Pakistan when it is geographically closer than many parts within India itself like Kerala or Tamil Nadu. In Pakistan people will not follow the sighting of Bangladesh but before 1971 when it was East Pakistan they would, why? The Messenger* said: "He is not one of us who calls for nationalism or who fights for nationalism or who dies for nationalism."
That’s why starting Ramadhan and celebrating Eid on one day is an obligation


Conclusion
* If a Muslim country announces that the sighting of a new moon has been confirmed according to the lawful way- for the beginning of Ramadhan or for the day of Eid – then you have to fast or celebrate Eid.
* It is forbidden to wait for a ruler or scholar in your part of the world to give you permission to fast.
Mu'az narrated: I said: O Messenger of Allah. What do you think if we had leaders who do not follow your Sunnah and do not adopt your order; in what do you order regarding their affair? The Messenger of Allah* said: There is no obedience to the one who does not obey Allah 'azza wa jall.”
Imam Muslim on the authority of Abu Hurayrah: that "The Messenger of Allah* forbade fasting on two days, the day of al-Adha and the day of al-Fitr".

Intro - Timeline of the Universe
Contextualising our existence in the scheme of the universe, we talked about a timeline. When the End of the World will be is unknown but in historical terms, it is pretty imminent – as preached by all the Prophets...

Prophet Musa* Leaves Egypt after Accidental Killing

Allah raised Musa in the house of Pharaoh – the centre of power. When he matured he was given Hikmah and Ilmah (Wisdom and knowledge). He was tall, strong, dark skinned and had very black curly hair according to the Prophet*.

In the Qur'an Allah relates the following event about the Prophet Musa’s* life: He (Moses) entered the city at a time when its inhabitants were unaware (midnight or midday) and found two men fighting there—one from Bani Israel and the other from the Egyptians. The Israelite asked for his support against the oppressive Egyptian. So Moses pushed him back with his stick and the other person fell and died accidentally. Musa* said, "This is part of satan's handiwork. He truly is an outright and misleading enemy." [TMQ 28:15]

The Prophet Musa*’s character was one of a person who would help people. But he realised his mistake and asked Allah for support. He said, "My Lord, I have wronged myself. Forgive me." So He (Allah) forgave him. He is the Ever-Forgiving, the Most Merciful. He said, "My Lord, because of Your blessing to me, I will never be a supporter of evildoers." [TMQ 28:16-17]

Pharaoh then convened an special council / task force to investigate the killing. As this involved the Muslims of the day (Bani Israel) Pharaoh wanted to make a big deal of this and treated this death as an act of terrorism that needed to be punished and the whole community put under fear and suspicion. Propaganda started that the Muslims (Bani Israel) may even try to set up their own government or want to overthrow the Egyptian way of life.

The next day Musa* returned to the same place fearful and on his guard when the man who had sought his help the day before, shouted for help from him again. Then Moses said to him, "You are clearly a misguided man." [TMQ 28:18] but the man mistook this and thought that Musa* may harm him. But when Musa* was about to grab the man who was their common enemy, he said, "Moses! Do you want to kill me just as you killed a person yesterday? You only want to be a tyrant in the land; you do not want to be a reformer." [TMQ 28:19]

Now the news was confirmed that Musa* had done the killing and now Pharaoh would make an example of him. Hence, Pharaoh and the leading followers discussed the Prophet Musa’s* punishment, even the possibility of executing him. Someone who overheard the discussion came to warn the Prophet Musa*. Upon this warning, the Prophet Musa* left Egypt: A man came running from the furthest part of the city, saying, "Moses, the Council are conspiring to kill you, so leave! I am someone who brings you good advice." So he left there fearful and on his guard, saying, "My Lord, rescue me from the people of the wrongdoers!" [TMQ 28:20-21]

Without time to pack or prepare Musa* had to leave immediately and headed East as quick as he could go – barefoot and alone.


Main Topic: Fiqh of Ramadhan part 2

* Sawm linguistically means refraining, silence, suspension. Shariah terminology means refraining from those things that break the fast and they are: food, drink, sexual relations, excess water through mouth/nose and vomiting, with the intention of getting closer to Allah from Fajr of a day until its Maghrib.
* Niyah (intention) needs to be made every night as fasting every day is an independent act of Ibadah.
*Whoever intentionally breaks a day of fasting in Ramadhan without a rukhsah (shariah permission) commits a major sin.
* Fasting is not obliged on the young until they have become mature (buloogh). Parents can train them from any age.
* Maghrib Prayer is after the Iftar (breaking fast)
* It is obligatory upon the sick person (Mareed) and traveller (Musaafir) to make Qadaa for what he has missed of the obligatory fasting. “O you who believe! Observing As-Saum (the fasting) is prescribed for you as it was prescribed for those before you, that you may become Al-Muttaqoon” [Observing Saum (fasts)] for a fixed number of days, but if any of you is ill or on a journey, the same number (should be made up) from other days. And as for those who can fast with difficulty they have (a choice either to fast or) to feed a Miskîn (poor person) (for every day). But whoever does good of his own accord, it is better for him. And that you fast, is better for you if only you know. [TMQ 2:183-184]


Fasting is broken by:
- Breaking of the Niyah of the fast
- Eating and drinking intentionally (see below)
- Menstruation and post Childbirth bleeding
- Sexual relations
- Vomiting intentionally - Ibn ‘Umar said: “Whoever is overcome by vomiting there is no Qadaa for him, and the one who makes himself sick must make Qadaa”. Ibn ‘Abbaas said that the Messenger of Allah (saw) said: “There are three which do not break the fast of the one fasting: Vomiting, cupping and wet dreams”.


Eating and Drinking: the entering of something into the throat and its swallowing, i.e. its entering into the Gullet/Oesophagus breaks the fast without any stipulation that it reaches the stomach or lungs
- Hence fast also broken by smoking or inhaling tobacco, purposely inhaling steam or smoke, taking inhalers or sniffing smelling salts, oral vaccines
- Some medical applications are allowed, such as: scope or surgical wound (as long as it avoids intestines & lungs), EEG, ECG, CT scan, X-rays, external examinations, skin vaccines, needles for blood, dialysis, bleeding, carefully using miswak or toothpaste


The descent of anything into the Gullet breaks the fast and this is obliged by the language because language dictates that whoever swallows a solid entity has eaten or if it is liquid has had something to drink. So the descending of anything into the Gullet is considered eating or drinking and eating and drinking are breakers of the fast, so if anything is swallowed the fast is broken - whether it is nutritious or not like a pebble or handful of dirt with no difference to whether it enters as a solid unit or as powder ingested with saliva or in a form of material that is in the air and turns into a sensed (congealed) form once inside. This includes:
- As-Su’oot, It is a type of Tobacco that is crushed, sniffed and it enters into the lungs.
- The smoking of Tobacco and the smoke of incense
- Steam from water or medicine
- Inhaler

However if any of this happened against the will of the person then it does not break the fast because Allah does not bring to account the action of the man which was against his will so whoever sits next to a smoker or burning incense sticks and something entered into his chest unintentionally and not wilfully then he remains fasting and has not broken it. Also if the weather situation and humidity meant that there were water particles in the air or in a bathroom dues to steam from hot water and the one fasting breathes this in without any desire to do so, intention or wish, then he has not broken his fast. Similar to this is the dust/sand in the air which occurs in cyclones and storms so if any of this is breathed in it does not break the fast and nothing breaks the fast except for what enters with somebody’s own will and intention.


Some Actions that do not break the fast
Smells: As for what can enter the Gullet but does not have a material sensed form such as perfume and other smells whether they are pure or dislikeable they do not break the fast and enter through the sense of smell without intention or purpose. Anas Bin Maalik that he said: “The Messenger of Allah* was asked: Can the fasting person kiss? He replied: And what is wrong with that, (It’s like) the smelling of a flower”.

Al-Qublah and Al-Mubaasharah (The kiss and fondling) - ‘Aa’isha said: “The Messenger of Allah* would kiss me whilst we were both fasting”. And also from ‘Aa’isha that she said: “The Messenger of Allah* used to kiss some of his wives whilst he was fasting and then she laughed”.

Al-hujaamah (Bloodletting) is the splitting/opening of the skin in the head with a tool called a Mihjam or Mihjamah followed by the Haajim (one performing al-Hujaamah) extracting the blood from the opening when there is an abundance of blood in the body. The process of donating blood in our present time is in reality the extraction of blood from the body and where the extraction of blood is permissible and does not break the fast we therefore can say that donating blood also does not break the fast. That the wound and what accompanies it ordinarily of external bleeding whether this has resulted from fighting in the way of Allah, from a car accident, or a shooting at a wedding or argument, or falling from a high place or any other situation or circumstance all of this does not break the fast. That the process of dialysis which is the extraction of the blood from the body in a purifying process and then the returning of this purified blood into the body, does not break the fast. The extraction of blood with a needle in order for it to be examined in a laboratory is permitted and does not break the fast. The needle of a doctor does not at all break the fast whether it is for medical treatment, to give nutrients/supplements, blood or anaesthesia and whether it is in the veins. This is all as long as no substances or medicines enter directly into the respiratory and digestives systems and their organs.


Caution: As for what a person with a heart illness or has suffered a stroke places under his tongue of pills which melt gradually as a remedy when the condition is intensified, then this breaks the fast if this forms a residue that could be swallowed. If it is entirely absorbed into the blood then it could be permissible providing none enters the gullet.

As-Siwaak (miswak): Aamir Bin Rabee’a said: “I saw the Messenger of Allah (saw) performing Siwaak whilst he was fasting, (so many times that it could not be counted)” The entering of any material in the mouth does not break the fast except if a material or substance that is emitted or comes off it is swallowed and it was possible to guard from it. However if it was not possible to guard from it, like a very small insignificant amount then there is no problem with this (i.e. it does not break the fast). So established on this principle it is permissible to TASTE FOOD and the placing of a THERMOMETER in the mouth is also allowed. Also that toothpaste or dentistry work is allowed and does not break the fast as long as nothing reaches the throat of substances or materials and is swallowed.

Prophet Musa (2): Birth


Birth: Musa was born in a time when his people (Bani Israel – children of Yaqub) were enslaved by the tyrant Pharaoh. They had arrived during Yusuf’s time but became slaves over the years. Pharaoh thought he was a god (amongst many other Egyptian gods) and that he owned the River Nile. This was a unipolar world.

Pharaoh had a dream that he would lose his kingdom to someone from the children of Israel so he started killing newborn males as he perceived it as an existential threat to his authority. His spies kept an eye on all the people and he ruled by Divide and Conquer.
Musa’s mother received WAHY (inspiration) from Allah: “Suckle him and then when you fear for him cast him into the sea. Do not fear or grieve; We will return him to you and make him one of the Messengers." (Surat al-Qasas: 7) and her test was to throw him into the river to save him – and this was a dangerous and big river!....

The Obligation of Fasting: "O ye who believe! Fasting is prescribed to you as it was prescribed to those before you…", (2:183)

The Reward for Fasting: The only one who knows about the reward is Allah (swt). "Every act taken by the son of Adam is done for him except fasting, it is for me and I make the reward", (Bukhari)

Fasting stops the Muslim from Sinning: "Fasting is a shield. Thus while fasting you must not use foul language or act like those of ignorance (screaming, attacking others, etc), or speak loudly". (Bukhari)

The smell of the Fasting persons mouth: "By the one who has my soul in his hands, the smell of the mouth of the fasting person is better for Allah than the smell of musk". [Bukhari]

Special Gate in Al-Jannah for those who Fast: " There is a gate in Al-Jannah called Ar-Rayyan which those who fast enter from on the day of judgment. And no one else enters from it. Once they enter from it, it is closed, and nobody else enters from it." (Bukhari)

Due to Fasting Previous Sins Are Forgiven: "Whoever fasts in the month of Ramadan purely because of his faith and sincerity all of his/her previous sins will be forgiven." "Whosoever does not saying and acting upon falsehood, Allah is in no need for him/her to abandon his/her food " (Bukhari).

The Intention is A Requirement for Fasting: The person who wants to fast must have the pure intention for doing that action only to please Allah (swt). The intention need not be said by the tongue, for the intention is act of the heart. Moreover, the intention must be settled in the heart before Fajr.

There Is Blessing in suhur: "have Suhur, for in suhur there is blessing. " (Muslim)

The Best Things To Keep Us Busy In Ramadan: The fasting Muslim should not curse, use foul language, harm people , talk nonsense, etc. Thus, the best the fasting person should keep him/herself busy with is the remembrance of Allah (Dhikr), attend sessions of knowledge, read Quran, and spend in the path of Allah, etc.

If Someone Eats Or Drinks, Forgetfully, Then he/she Completes The Day Of Fasting: "If he forgets and eats and drinks, then he should complete his fast. It was Allah who fed him and gave him the drink." (Bukhari).

If deliberately broken the fast, Muslim needs to:
- Free a slave
- fast two months consecutively
- feed sixty poor people

Permission To Break Fast In Travelling and Sickness: Allah (swt) permitted us to break fast in travelling and in sickness on the condition that we make it up later on. "And for those who are sick or travelling, then (the prescribed period should be made up) other days."
It is only the sickness, that fasting will delay its recovery or worsen it, that permits the person to break the fast. But, the one that is not affected by the fast is not a legitimate excuse. Travel depends upon the distance travelled – often taken as 48 miles.

The Elderly and the Incurable sick: do not have to make up the days that they have missed, for they are unable to do so but have to feed one poor person as (Bukhari)

The fasting of Children and Teaching Them Manners: Only those who are above the age of puberty and sane are addressed by Shari’ah. "Order your children to pray when they are seven years of age, beat them for it when they are ten years of age, and separate them in their beds".(Abu Daud). Also Bukhari narrates "We used to make our children fast and make their toys out of wool. If any of them cried because of hunger, we would give them toy till the time to breakfast". There is no sin if the children break the fast for them or the parents.

What is recommended for the Saa’im to break his fast with: Recommended to make Iftar with Rutub (fresh, moist, ripe dates), if not then Tamr (dry dates); else to take mouthfuls of water then eat what they wish.

Time to break fast: Is at Maghrib when the adhaan happens and not to wait until after prayer or to delay.

Salatul-Taraweh: Abu Huraira said, "I heard the messenger of Allah (saw) say, "The one who does qiam in Ramadan with faith and sincerity, all his/her sins will be forgiven".
